This includes your IP address, browser and device type, approximate location based on your IP address, pages viewed, links clicked, the site that referred you, and cart and checkout activity. See "Cookies, pixels and advertising" below.

We don't ask for sensitive personal information, such as Social Security, driver’s license, state ID or passport numbers; account login or financial account credentials; precise geolocation; racial or ethnic origin; religious or philosophical beliefs; union membership; the contents of your mail, email or texts (unless we are the intended recipient); genetic or biometric data; health, sex life or sexual orientation information; citizenship or immigration status; data from a known child; or criminal history. Please don't send it to us.

We collect only the personal information that is reasonably necessary and proportionate for the purposes described in this policy, and we periodically review what we collect to keep it that way.

How we use information

We use personal information to:

  • Process, ship and track your orders, and handle payments, returns, refunds, warranty claims and claims for packages lost or damaged in transit.

  • Send order and shipping updates.

  • Answer your questions and provide customer service.

  • Send marketing emails if you've signed up. You can unsubscribe at any time.

  • Run launches, promotions, limited releases and any subscription program you take part in, including sending subscription confirmations, renewal reminders and cancellation confirmations.

  • Understand how people use the Site and improve it.

  • Show you HydroSport Max ads on other sites and apps, and measure how they perform.

  • Prevent fraud, abuse and security problems.

  • Comply with the law, enforce our Website Terms of Use and our Terms and Conditions of Sale and protect our rights and properties.

  • Protect or enforce the rights and properties of others (which may include you).

  • Do anything else we tell you about when we collect the information, or that you agree to.

We may also create de-identified or aggregated information that can't reasonably be linked to you, and use it for any lawful purpose. We won’t try to re-identify de-identified information.

How we share information

We don't sell your personal information for money. But we do disclose certain information to advertising partners in ways that some state laws treat as a “sale” or “sharing,” as explained below. We share your personal information with:

  • Service providers that work on our behalf: Shopify (our e-commerce platform and payment processor), fulfillment and warehouse partners, shipping carriers, email and customer service tools, analytics providers, and IT and security providers. They may use your information only to provide services to us.

  • Advertising and analytics partners such as Google, Meta and TikTok, through cookies and pixels on the Site. Some state privacy laws call this a "sale" or "sharing" of personal information, or "targeted advertising." You can opt out, as explained under "Your choices."

  • Sales channels and marketplaces you choose to buy through.

  • Professional advisors such as lawyers, accountants and auditors.

  • Authorities and others, when required: to comply with the law or legal process, or to protect the rights, property or safety of HydroSport Max, our customers or others.

  • A buyer or successor if we're involved in a merger, acquisition, financing or sale of all or part of our business. If that happens, we’ll let you know by email or a prominent notice on the Site of any change in ownership or in how your personal information is used, and we’ll seek appropriate protection for your information in the transaction.

  • Anyone else, with your consent or at your direction.

About Shopify. Our store runs on Shopify, which processes personal information to provide its services to us. To learn more, see the Shopify Privacy Policy. If you use Shop Pay or the Shop app, Shopify's own consumer privacy terms also apply to that use.

Third-party sites. The Site and our emails may link to third-party sites, apps and platforms, such as social media pages and sales channels. Those third parties have their own privacy policies, and we aren’t responsible for their practices. Please review their terms and privacy policies.

Cookies, pixels and advertising

We use cookies and similar technologies to run the store (for example, keeping items in your cart), remember your preferences, understand how the Site is used, and show and measure ads. The tools on the Site include:

  • Shopify cookies, needed for the store, cart and checkout.

  • Google Analytics 4 and Google Tag Manager, to measure Site traffic and how visitors use the Site. You can opt out with the Google Analytics opt-out browser add-on.

  • Meta Pixel (Facebook and Instagram), for marketing and advertising.

  • TikTok Pixel, for marketing and advertising.

  • X, for marketing and advertising.

  • Google Ads and Google Merchant Center, for marketing and advertising.

You can block or delete cookies in your browser settings, though parts of the Site, such as the cart, may not work without them. You can also limit personalized ads through each platform's ad settings, the Digital Advertising Alliance and the Network Advertising Initiative.

Global Privacy Control. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising for that browser. Some browsers also send "Do Not Track" signals. There's no common standard for those, so we don't respond to them.

Your choices

  • Marketing emails: click "unsubscribe" in any marketing email, or email us. We'll process your request within 10 business days. We’ll still send emails about your orders. Our marketing emails won’t use false or misleading subject lines, and they will identify themselves as advertisements and include our physical address.

  • Text messages: we don't currently send marketing texts. If we start, we'll ask for your consent separately first.

  • Targeted advertising: use the "Your Privacy Choices" link in the Site footer, email us with “Do Not Sell or Share” in the subject line, or turn on GPC in your browser. You don’t need an account to opt out. We’ll process your opt-out within 15 business days, and we won’t ask you to opt back in for at least 12 months.

  • Cookies: use your browser settings, or the cookie banner where one is shown.

  • Your account details: sign in to update them, or email us.

Your privacy rights

Depending on where you live, you may have the right to:

  • Know and access the personal information we hold about you, and get a copy in a portable format.

  • Correct information that's inaccurate.

  • Delete your information, subject to legal exceptions (for example, order records we must keep for tax purposes).

  • Opt out of the sale or sharing of your personal information, targeted advertising, and profiling that has legal or similarly significant effects. We don't do that kind of profiling.

  • Not be treated differently for using any of these rights. Unless the law allows it, we won’t deny you goods, charge you different prices, give you a different level of quality, or suggest that we will, because you used your rights.

  • Appeal if we turn down your request.

California and a growing number of other states, including Colorado, Connecticut, Oregon, Texas and Virginia, give their residents these rights. We honor these requests from all U.S. customers, wherever you live.

How to make a request. Email marketing@hydrosportmax.com with "Privacy request" in the subject line, write to us at the mailing address below, or use the "Your Privacy Choices" link in the Site footer. In your request, please tell us what you’re asking for, your name, address and email, and whether you want our response by mail or email. Before we act on a request to access, correct or delete information, we'll confirm your identity by matching details you give us with our records, such as your email address and a recent order number. You can also ask an authorized agent to make a request for you. The agent must provide a valid power of attorney or your signed written permission and proof of the agent’s identity, and we may also ask you to confirm your identity and the authorization directly with us. We'll respond within 45 days. If we need more time, we'll tell you why, and we may take up to 45 more days where the law allows.

Appeals. If we decline your request, you can appeal by replying to our decision within 60 days with "Appeal" in the subject line. We'll respond within 60 days. If you're not satisfied with the result, you can contact your state Attorney General.

Please tell us right away at marketing@hydrosportmax.com if you learn of any unauthorized access to your account or use of your login information.

How long we keep information

We keep personal information only as long as we need it for the purposes in this policy, including legal, tax and accounting requirements. For example, we keep order records for 7 years. We keep email signup information until you unsubscribe, and then keep a record of your email address only so we don't email you again. Analytics data is kept for up to 14 months. We keep account information for as long as your account is open plus 3 years, customer service records for 3 years after the issue is resolved, and records of privacy requests and appeals as required by law. Any information we keep is limited to what’s needed and stored securely, and when it’s no longer needed we securely delete or anonymize it.

We're based in the United States, and the Site is intended for customers in the United States. Your information is processed in the United States and wherever our service providers operate. We may update this Privacy Policy from time to time. We'll post the new version here and change the "Last updated" date. If we make material changes, we'll also let you know by email or with a notice on the Site.

Severability

If any part of this Privacy Policy is found invalid or unenforceable, the rest will stay in effect, and the invalid part will be enforced to the maximum extent the law allows, consistent with the intent of this policy.

Governing law and disputes

This Privacy Policy is governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict of law rules. Any dispute arising out of or relating to this Policy is subject to the dispute resolution provisions of our Website Terms of Use, including the requirement that you and we first try in good faith to resolve the matter informally, the agreement to resolve disputes by individual arbitration, the waiver of class and representative proceedings, and your right to opt out of arbitration within 30 days. If those arbitration provisions do not apply to you or are held unenforceable, any dispute will be heard in the state or federal courts located in Fulton County, Georgia.
